Comment: New framework for civil juries

A bench of five judges in the first division of the Inner House of the Court of Session has radically altered the way in which future civil jury trials will be conducted in Scotland, says David Di Paola.

The court was concerned with two cases - Hamilton v Ferguson Transport (Spean Bridge) and Thomson v Gordon Thomson Builders (2012) - where the defenders in each were applying for a new civil jury
