The recent Supreme Court decision in David T Morrison v ICL Plastics turned the Scottish legal profession’s understanding of the law of prescription on its head.

The court held that the start of the five-year prescriptive period for negligence claims was postponed only until the claimant was aware they had suffered loss. Previously the law had been interpreted
