Lloyd's underwriter in signficant disclosure victory
The Court of Appeal today held that Lloyd’s underwriter, Goshawk, was entitled to access placing and claims documents held by brokers, Tyser, which it had previously been shown by the brokers. Last year the English Commercial Court decided that Lloyd’s underwriters were entitled to receive from the brokers’ files, only accounting documents relevant to the risk underwritten at Lloyd’s, but had refused insurers access to the placing and claim files.
Goshawk’s application to the Court of Appeal was supported by Lloyd’s, and the ruling will mean that underwriters will now have access to documents on brokers files which they have previously seen
