In the recent case of Poll v Viscount and Viscountess Asquith of Morley (2006), the court considered how far a landowner's duty of care extends when it comes to assessing the risks posed by roadside trees
The claimant, a motorcyclist on a public highway, collided with a branch that had fallen from a tree growing on the defendants' land. The defendants were responsible for the maintenance of the tree
